HLAA has learned that a proposed settlement was announced in a case claiming that Nike, Inc. had violated the Americans with Disabilities Act by requiring their employees wear face masks but failing to ensure customers with hearing loss were provided with appropriate accommodations.
As part of the settlement, Nike has agreed to make transparent face masks available to its California store employees, provide guidance to its employees about how to accommodate customers who deaf or hard of hearing, and post signs at the entrance to each California store notifying customers who are deaf or hard of hearing that they may request additional assistance. Nike has agreed to implement these changes by the end of January 2021.
